The Law Society of Hong Kong has outlined proposed enhancements to the registration framework for trainee solicitor contracts, centred on revisions to the Application for Registration of Trainee Solicitor Contract, or Form AA. The current form requires disclosure of matters including criminal convictions, disciplinary offences at educational institutions and bankruptcy proceedings. The revised form would broaden and clarify those categories by requiring applicants to disclose arrests and charges in any jurisdiction, inclusion on a wanted-persons list, and disciplinary or regulatory findings, sanctions, proceedings and investigations involving statutory bodies, enforcement authorities or sanctions authorities.
It would also extend disclosure to financial and corporate matters such as bankruptcy or analogous proceedings, director disqualification and certain winding-up or dissolution events involving businesses with which the applicant has been associated. Applicants would additionally give an express undertaking to notify the Law Society immediately of relevant changes in circumstances. The Law Society stresses that the purpose is to improve the information available for assessing character, fitness and suitability under the Trainee Solicitors Rules. Applications will continue to be considered holistically and individually, without rigid or automatic disqualification solely because a matter has been disclosed.
